Special teleconference minutes – June 23, 2020 call

Meeting called to order at 6:03 PM via teleconference on Tuesday, June 23, 2020.
Mike McCrea read the roll of attendees.
1699 Silverwood:
The property line for 1699 Silverwood extends into the pond. Residents have long walked this section, considering it is part of community grounds. The owner raised concerns over liability and privacy due to foot traffic and asked that residents be discouraged from walking through their property.
The board could not find any documents that showed that the grassy area was ever made community property. We reached out to our attorney, who suggested we offer to extend community liability coverage to the pathway if the residents were willing to grant an easement. We offered this and the residents declined.
Before the meeting, Mike spoke with the owner and asked that they find some unobtrusive way to discourage foot traffic and to be courteous explaining the property concern with neighbors who have grown accustomed to walking through.
Tracie Priest stated that the arrangement sounds fair. Fred Willes asked why the board thought it was residents’ responsibility to discourage foot traffic and suggested that the ramp on that side of the gazebo bridge be removed.
Llona Geiger noted that if the land is on private property, there was 35 years of ‘tenancy in common’ resulting from neighborhood design and usage. She noted that an earlier survey may not have extended to the water.
Llona motioned that the property owner have a land survey done, and to table any board action with regard to the path until complete. The motion did not receive a second.
Tracie stated a survey was not needed, as there is a monument established within the pond at one corner of the property. Mario Lopez stated that professional experience confirmed that the property line had to be certified before taking any actions.
Mike amended Llona’s motion that the association would have the survey done at 1699 Silverwood, and any board action regarding the pathway would be tabled until the survey was finished.
Kristen Crosby, the property owner, spoke up and acknowledge sympathy for residents trying to keep the neighborhood as it is, but didn’t realize the path was so close to the house when purchased. She noted that people walk through the area after dark, and that primary concern is liability and privacy.
Mike redirected discussion to the motion on the table, and Llona seconded. The motion was put to vote; Mike and Llona voted in favor and Tracie opposed.
Conversation continued regarding the property, and the board reiterated that no decision would be made pending completion of the survey.
Tracie responded to Fred’s earlier question about the ramp, noting that there is community ground between the gazebo bridge and the private property, and it should not be removed. Mike agreed that regardless of survey results, the board does not intend to modify the gazebo bridge.
While the land is at issue, Mike advised he will post a notice to Nextdoor asking residents not to use that section of the path. Additionally, caution tape will be added as a temporary measure to discourage traffic until the dispute is resolved.
Boardwalk repairs: Mike and Ray (from TPAM) walked the property and documented miscellaneous boardwalk sections in need of repair. Mike showed the section off the gazebo bridge that is decaying and Ray mentioned they have a new guy who does wood work, and would see if he could do this repair as well. TPAM’s estimate for all repairs, including the ramp and walkway repair was around ~800 for labor and materials.
Because the motion at last meeting was only to get estimates, Mike motioned to forego other estimates from third party contractors and have TPAM do all repairs. The motion passed unanimously.
Debbie Taggart asked if the repair included the partially completed boardwalk behind her house. Mike confirmed that it did not, but that the amended project request has been submitted to TPAM for final revisions before being sent to the city for permit application.
Audrey Johnson asked about the trees that have recently fallen into the pond, and Mike advised that a call to AAA was made last week for estimates to cut and remove the fallen trees from the pond and a dead tree on community land near Orange Avenue. Audrey also noted that there are still two alligators in the pond and would send photos to the board.
Mike moved to adjourn the meeting at 6:53 PM and the motion passed unanimously.
